OUTBOUND PACKAGE TOUR SALES CONTRACT AND GENERAL TERMS
1. PARTIES AND SUBJECT MATTER
This contract is concluded between the consumer purchasing the tour (hereinafter referred to as "Guest") and the Travel Agency organizing the tour, for the purpose of defining the sale, scope of services, and rights/obligations of the parties regarding the "22nd Traditional Lesvos Chestnut Festival Tour (3 Days - 2 Nights)" program, in accordance with the provisions of the Turkish Republic Law No. 6502 on the Protection of Consumers and the Regulation on Package Tour Contracts. The Guest is deemed to have accepted all terms of this contract in advance upon completing their reservation and making the payment.
2. SCOPE AND DURATION OF SERVICE
The service subject to this contract includes round-trip ferry transportation from the Guest's chosen departure port (Ayvalık, Dikili, or Aliağa) to Lesvos Island, guided sightseeing tours within the island via luxury buses (Mandamados, Petra, Molivos, Plomari, Agiasos), 2 nights accommodation with breakfast in 3-star hotels, and 1 night dinner at a Taverna. All items listed under the headings "Included" and "Not Included" on the tour detail page are an integral part of this contract.
3. PAYMENT TERMS
- At the time of registration, at least 30% of the tour fee (or the pre-payment amount determined by the system) must be paid, and the remaining balance must be settled no later than 15 days before the tour departure date.
- In case payments are not completed within the specified periods, the Agency reserves the right to unilaterally cancel the reservation and record the collected pre-payment as "administrative fees".
- Tour prices are calculated based on international exchange rates, port taxes, and fuel prices at the time of reservation. Extraordinary fuel price increases or new international taxes that may occur until the travel date can be passed on to the customer within legal limits.
4. CANCELLATION, REFUND, AND MODIFICATION CONDITIONS
Every guest who completes this reservation is deemed to have accepted the following cancellation conditions prepared according to international ferry passenger transport and hotel commitment rules:
- Official Notification: Requests for cancellation, refund, date change, or name change must be notified to our agency via email or written petition to be legally processed. Verbal notifications, phone calls, or instant messaging (WhatsApp, etc.) are legally invalid.
- Deduction Rates: For cancellations made up to 30 days before the tour departure date, the full amount paid is refunded without deduction. For cancellations made between 29 and 15 days before the tour departure date, 50% of the package fee is deducted, and the remaining amount is refunded. For cancellations made 14 days or less before the tour departure date or in cases where the guest does not appear at the departure point on the day of the tour (No-Show), no refund will be issued (100% penalty).
- Promotional Sales: Tours purchased at advantageous prices with labels such as "Early Reservation", "Last Minute", or "Special Promotion" do not allow any cancellation, refund, or date change, regardless of how close the tour date is (100% penalty).
- Health Issues and Committee Report: In cases of cancellation due to sudden health issues/death of the participant or a first-degree relative, refunds are handled by the INSURANCE COMPANY if the guest has purchased a comprehensive policy. A formal COMMITTEE REPORT (signed by the Chief Physician and at least 2 specialist doctors) obtained from fully equipped state hospitals is mandatory for insurance refunds. Reports from private hospitals or single-doctor reports are invalid. Chronic illnesses are excluded from coverage.
5. VISA, PASSPORT, AND CUSTOMS REJECTION RESPONSIBILITY
- A valid Schengen Visa, Green Passport, or Door Visa approval is mandatory for this tour. Passports must be valid for at least 3 months after the end of the trip.
- Our agency acts solely as an intermediary between the guest and the consulate/border police. Rejection of the visa or Door Visa application, failure to obtain the visa in time, presence of a Northern Cyprus stamp in the passport, passport wear and tear, lack of consent form for persons under 18 years old, or a criminal ban on leaving the country resulting in the border police refusing entry into the country is entirely the personal responsibility of the guest.
- These situations are not considered force majeure; no refund is made, and the standard penalty rates stated in Article 4 are applied strictly. Visa application fees and processing charges are never refunded in case of visa rejection.
6. FORCE MAJEURE AND OPERATIONAL AUTHORITY
- Delays in ferry schedules may occur, or our guide may make changes to the tour program or route order (including the taverna night day) due to force majeure events beyond our agency's control, such as adverse weather conditions (storms, strong winds), sea traffic, decisions by official authorities (Port Presidency), or excessive congestion at border crossings. These situations do not constitute grounds for free cancellation or claiming compensation from the agency.
- If the ferry schedule is completely cancelled by official authorities due to adverse weather conditions, the guest's right is converted to an open ticket, or 100% of the paid amount is refunded without deduction.
- In case the outbound ferry is missed due to late arrival at the port meeting time, the ticket becomes void (No-Show). Guests who arrive late during free times designated by the guide during the tour, causing delays for the group, must return to the hotel/port at their own expense and risk.
7. LUGGAGE AND PERSONAL BELONGINGS
The safety of luggage and personal belongings (phones, cameras, wallets, passports, etc.) carried by guests throughout the tour is entirely their own responsibility. Our agency cannot be held liable for items forgotten, lost, or stolen inside the ferry, customs areas, hotels, buses, or at sightseeing points.
8. COMPETENT COURT
In any dispute arising from the implementation and interpretation of this contract, the Consumer Courts and Consumer Arbitration Committees of the Turkish Republic are competent. When the guest purchases the tour in digital or physical format, they are deemed to have read, understood, and approved this contract.
